7 General Terms and Conditions for the Reload Festival

These General Terms and Conditions (“GTC“) apply to the entire event site for the duration of the event. These GTC apply between the holder of a ticket (“Visitor“) and the organizer, Reload Event GmbH (“Organizer“) for the visit to the “Reload Festival” (“Event“).

By purchasing a ticket, the visitor concludes an event contract with the organizer and acquires the right to attend the event. By purchasing a ticket, every visitor declares their agreement with these GTC.

Definitions

    1. Organizer: Reload Event GmbH, Rudolf Diesel – Straße 5, D-27232 Sulingen, Mail: info@reload-festival.de, Management: Andre Jürgens, Commercial Register: Walsrode – HRB 20 3187.
    2. Event: The event “Reload Festival” consists of the entirety of the program sequences (music and supporting program) in connection with the event “Reload Festival” as well as the arrangements made by the organizer directly for this event for the arrival, stay and departure of the visitors.
    3. Event site: The event will take place on the designated festival site in the town of Sulingen, district of Diepholz in Lower Saxony. The event site includes all areas to which access is only granted with a valid ticket or other access authorization from the organizer. This also includes the area in front of the main and side stage (“infield“) and its forecourts, the festival plaza as well as parking and camping areas.
    4. Event period: The event begins on 15.08.2024 and ends on 17.08.2024.
    5. Consumer: Any natural person who purchases a ticket for purposes that are predominantly outside their trade, business or profession.
    6. Event area: The infield including all areas of the stage or supporting program as well as the Festival Plaza (“forecourt”)
    7. Parking and camping areas: The entirety of all parking and camping areas set up for the event, including access routes from the public traffic area and access routes to the event site.

Tickets, prohibition of resale, contractual penalty

    1. Tickets can only be purchased from Reload Event GmbH (www.reload-festival.de). The General Terms and Conditions of Reload Event GmbH apply to the purchase. These are available at www.reload-festival.de.
    2. After validation by the organizer or a company commissioned by the organizer, a transfer is no longer permitted.
    3. Tickets for the event are sold exclusively for private, non-commercial use by the purchaser.
    4. The transfer of visiting rights to a third party is only permitted with the consent of the organizer. The organizer generally agrees to the transfer of visiting rights to a third party if there is a legitimate interest, unless
      1. The third party is banned from the premises;
      2. the visiting right is offered at a higher price than the nominal price of the ticket. This also applies to fees charged in addition to the nominal price;
      3. This is not a private sale, i.e. a commercial or industrial resale;
      4. the sale is brokered commercially or commercially by an unauthorized third party, in particular an Internet service provider, carried out via unauthorized third parties or processed by unauthorized third parties, in particular by marketplaces and ticket resellers on the Internet not authorized by the organizer (e.g. Ebay);
      5. the transfer is directly or indirectly related to advertising measures, unauthorized travel packages, bonus gifts or competitions. Any transfer or resale without the organizer’s consent will result in the loss of access authorization without compensation, i.e. in this case the ticket loses its validity and the organizer is entitled to confiscate the ticket without compensation.
        1. The purchaser of a ticket undertakes to refer to the transfer restrictions of this section and the validity of these GTC each time the right to visit is transferred or a ticket is resold and to agree to these as an integral part of the contract.
        2. For each culpable breach of the above conditions of consent, the purchaser shall be obliged to pay a contractual penalty, which the organizer shall determine at its reasonable discretion. The Buyer may have the amount of the contractual penalty, which may not exceed EUR 2,500.00, reviewed by a court of law for appropriateness. In the event of a breach of the above prohibition, the organizer is entitled to withdraw the right to visit or to confiscate the ticket. This also applies if the ticket was purchased in good faith by a third party.

Arrival, parking, camping, cleanliness

    1. A valid ticket also entitles the holder to single parking and camping on the camping area in the designated zones on the event site from 15.08.2024, 12.00 noon, without any further surcharge on the ticket. The organizer will announce details on early arrival on 14.08.2024 (subject to a charge) separately and before the festival via its own homepage(www.reload-festival.de) and the festival’s social media pages. Basic parking and camping includes one car and camping in the immediate vicinity.
    2. The StVO applies throughout the event site. Vehicles must be driven at a suitable walking speed throughout the entire site; unnecessary movements are prohibited.
    3. The parking spaces are limited to the allocated areas, the allocation is binding. There is no entitlement to parking in a specific area. After parking, the movement of vehicles is no longer permitted until departure, unless the movement of the vehicle is ordered in accordance with the following regulations.
    4. Motorhomes, caravan combinations and heavy vehicles may park in a separately designated area after allocation, although escort vehicles are generally permitted. Motorcycles can be parked anywhere in the mixed area. The driver is responsible for proper and stable parking. It is the visitor’s responsibility to check that the surface is suitable.
    5. Vehicles parked outside designated parking areas or parked on driveways or in emergency lanes in such a way as to obstruct passage may be towed away without prior warning. The fees incurred for this shall be borne by the person responsible.
    6. The parking permit expires if the vehicle is not covered by liability insurance and does not have an official license plate with a valid inspection sticker or has had its operating permit withdrawn for other reasons. The same applies if the vehicle has been parked with defects that are hazardous to the environment or health.
    7. No agricultural tractors, tractors, other heavy (over 7.5t) or agricultural equipment and other heavy equipment (over 7.5t) that is likely to cause serious damage to the ground on the event site may be driven on the event site without prior written notification and the corresponding consent of the organizer. If approved by the organizer, these vehicles must be parked in designated areas on the instructions of the organizer’s staff. The organizer reserves the right to set a fee at its reasonable discretion in accordance with the additional expense and to inform the visitor of this in advance when registering the vehicle.
    8. Generators up to 2 kW are permitted in the camping area if they are in perfect condition, in particular if they do not leak oil or fuel. Operation is permitted until midnight. A maximum of 5 liters of fuel may be carried in additional tanks per vehicle. All power units must be operated in a technically perfect and well-maintained condition in accordance with the operating instructions. The operation of gensets and other power sources must be monitored at all times. Only power units approved for use in the European Union may be used.
    9. Camping is generally possible directly next to the vehicle; visitors are not entitled to this. All tent structures must be stable and weatherproof. Visitors are responsible for the road safety of the facilities and structures they erect. The erection of large tents is prohibited. The digging of hollows, holes and trenches is just as prohibited as the construction of towers, frames and other structures. Tent structures are only permitted for the accommodation of people. Visitors are responsible for the traffic safety of the facilities they erect. Facilities and structures that are not safe for traffic must be dismantled by the visitor. The organizer is entitled to remove unauthorized facilities and structures at the visitor’s expense if and to the extent that this is necessary to effectively avert danger.
    10. Visitors arriving by train, shuttle bus, coach or cab can reach the camping area on foot via the entrance.
    11. The organizer reserves the right to specify the size of the available space. Large and specially equipped areas may be subject to an additional fee.
    12. Environmental protection and the principles of waste avoidance and correct waste disposal must be observed. For fire safety reasons, the allocated stand area must be regularly cleared of garbage. Garbage must be collected and disposed of at the designated garbage collection points. Additional garbage bags are available free of charge for garbage collection. Waste water may only be emptied into the sinks provided for this purpose. At the end of the stay, the pitches must be left in a tidy condition. Visitors are obliged to take all items they have brought with them or to dispose of them properly. In particular, visitors’ own camping equipment must be completely dismantled and taken away.
    13. In the event of poor ground and road conditions, temporary driving bans may be imposed and, for safety reasons, a move to another parking area or a temporary stay in the vehicle may be ordered. If the weather situation makes it necessary, a separation of camping and parking can be ordered.
    14. The organizer shall provide detailed information on arrival, the start of camping and any alternative options in good time before the start of the event. Visitors are obliged to inform themselves regularly about the course of the weather and in particular about the approach of short-term weather events (thunderstorms, hail, storms, etc.).
    15. The event site must be vacated by 12:00 noon on Sunday, 18.08.2024 at the latest.

Admission, admission control

    1. Admission to the event site is only possible with a valid ticket or intact festival wristband. The ticket must be presented at the first entrance and exchanged for the wristband at one of the wristband desks. The ticket can be presented as a printed ticket or as a digital ticket on a mobile device (smartphone or similar). Visitors who leave the event grounds will only be granted re-entry if they are wearing a sealed, undamaged wristband around their wrist.
    2. The wristband is not transferable. Unsealed or tampered with wristbands lose their validity and are invalidated.
    3. When entering the event site, security checks may be carried out by the security service on site (e.g. vehicle checks, bag checks). The security service is instructed to carry out body and bag searches on visitors, particularly when entering the infield. Visitors agree to this.
    4. Bags are prohibited on the entire event site. This includes all bags, rucksacks and similar containers. Bags up to a maximum size of 30cm x 20cm x 5cm are exempt from this bag ban.
    5. The organizer reserves the right to refuse admission to the event site to a visitor for good cause or to exclude the visitor from the event. Good cause includes, but is not limited to, the carrying of prohibited items in accordance with Section 8, an obviously heavily intoxicated state of the visitor, if the visitor is obviously under the influence of drugs or if the visitor has an obviously homophobic, sexist, racist or inhuman attitude. Admission will also be refused if the protection of minors is violated. If there is an important reason for refusing admission for which the visitor is responsible, the ticket and wristband will lose their validity and the admission price will not be refunded.

Hygiene, infection protection

    1. The visitor undertakes to fulfill any official requirements for participation in major events (e.g. PCR entry or exit test, rapid antigen test, etc.) at his own expense. The visitor agrees to provide the organizer with any necessary digital or analogue medical history sheet on his/her own state of health. The visitor also agrees to provide digital or analog information on vaccination and/or test status and, if necessary, to allow automated data comparison.
    2. The visitor undertakes to refrain from participating in the event in the event of physical symptoms that may indicate an infectious disease (SarsCov2, influenza or similar). In the event of symptoms that may indicate an infectious disease, the visitor undertakes to draw attention to this and to contact the local medical service.
    3. The organizer reserves the right to carry out suitable and necessary infection protection measures to protect visitors to the event from serious infectious diseases (e.g. rapid antigen test on entry, PCR testing, fever measurement, etc.). This also applies if the measures are not prescribed by the authorities. The visitor agrees to bear the costs incurred for their own testing. There is no entitlement to the implementation of special measures.
    4. The organizer may prescribe special rules of conduct for visitors to the event and impose measures (e.g. AHA rules, route/direction restrictions, quantity limits, temperature measurements, testing requirements). The visitor undertakes to observe and comply with these regulations. Visitors or ticket holders who do not observe or comply with these regulations may be expelled from the event grounds.

Prohibited items

    1. The following are prohibited on the entire event site:
      • Glass bottles of any kind,
      • Animals/pets,
      • Weapons of all kinds (also in the technical sense),
      • so-called selfie sticks,
      • Torches, pyrotechnic objects, sparklers, sky lanterns,
      • Vuvuzelas, megaphones,
      • Drones,
      • Firewood,
      • Bulky waste (old sofas, armchairs, building materials, wood, etc.)
      • Shirts, sweaters, patches, etc. of bands with an anti-constitutional background, in particular if they are under observation by the Office for the Protection of the Constitution or are subject to bans due to anti-constitutional publications; and
      • dangerous objects of any kind, unless they are objects of daily use that are used in a socially acceptable manner and for their intended purpose;
      • without prior written permission, photo, film or video cameras or other recording devices which, due to their equipment, type and size, are obviously not intended solely for private use.
    2. For safety reasons, it is also not permitted on the infield and the Festival Plaza or in the immediately adjacent areas, in any event tents on the site or on stages:
      • any form of glass container (including perfume bottles),
      • Camel bags, canisters, plastic bottles, PET bottles, cans (including hairspray, deodorant, etc.) and other drinking containers;
      • CS gas, pepper spray,
      • Studded bracelets, studded necklaces and belts with raised or pointed studs or studs longer than 1.5 cm;
      • Chains, flagpoles, sticks;
      • Cartridge belt,
      • Hard packaging, cooler bags, other heavy containers.
    3. The organizer is entitled to temporarily store and take possession of prohibited items or to expel the visitor in question from the event grounds.

House rules, rules of conduct, photography and filming

    1. The householder’s rights are exercised by the organizer and its stewards and security personnel.
    2. The instructions of the organizer’s staff must be followed. The current notices and safety instructions on site also apply.
    3. All visitors must behave in such a way that no one else is harmed, endangered, hindered or inconvenienced. Visitors are prohibited,
      1. to carry prohibited items (Section 8) on the event site,
      2. to use physical violence against other visitors, the organizer’s staff or other third parties;
      3. throwing objects at the stage or other visitors;
      4. urinate or defecate outside the toilets;
      5. to paint, spray or soil structures, walls, objects, etc;
      6. to operate commercial deposit collection and/or to set up so-called “bunker tents” for storage;
      7. to trade commercially, carry out marketing campaigns or advertising measures without the prior written consent of the organizer;
      8. to carry out advertising measures of any kind, i.e. the promotion of a product, a service, a belief or religion, a trade union or party, a company or a brand, the distribution or presentation of political or religious content in any form (e.g. on books, flyers, banners, signs, electronic devices, etc.),
      9. to place decorations and other objects on the entire event site; and
      10. to enter areas and rooms that are not open to visitors and to climb onto stages, tents, trusses or similar.
    4. After midnight, the volume of music systems must generally be reduced to a level that is acceptable to the camping community. Power generators may only be operated if and as long as they are safe to operate, there is no danger to the environment, the exhaust fumes do not endanger any persons and no other guest feels disturbed by the noise.
    5. Barbecues are permitted, open fires and campfires are prohibited. The unauthorized construction of fireplaces in camping areas or parking lots is prohibited due to the resulting fire hazard. Only tested and technically flawless charcoal lighters, gas cartridges, gas bottles (only permanently installed in the camper) and barbecue equipment purchased in stores are permitted. All gas appliances must be in perfect technical condition and comply with the German DIN standard. Only gas cartridges (piercing and valve cartridges) up to a maximum filling weight of 450g and gas cylinders up to 5kg may be used. Liquid gas systems installed in vehicles must have a valid gas pressure test. Only barbecue food may be placed on the burning barbecue and nothing other than barbecue food may be thrown onto the glowing coals, especially not gas cartridges. After barbecuing, the charcoal must be allowed to burn out. Sudden extinguishing with water produces large quantities of hot steam, which can cause scalding. It is forbidden to pour charcoal onto the lawn to burn it out. Barbecues may be prohibited for safety reasons during storms or similar weather conditions. If a fire breaks out, the security service must be informed immediately, even if the fire can be extinguished. Generators with an output power of up to 2 KW are permitted in the parking and camping areas if they are in perfect condition and, in particular, do not leak oil or fuel. Operation is permitted until midnight. A maximum of 5 liters of fuel may be carried in additional tanks per vehicle. Power units must be used in perfect technical condition. Only units that have been tested and approved in the Federal Republic of Germany may be put into operation.
    6. Photography for private use with cell phones is permitted. The personal rights of third parties must be respected at all times. The making of film or sound recordings of any kind and their publication online or offline without the permission of the organizer is prohibited.
    7. Visitors who culpably violate the above rules of conduct or rules of conduct may be expelled from the event site by the organizer and banned from the premises. If a visitor commits or attempts to commit a criminal offense at the Reload Festival (e.g. drug dealing, assault, theft, sexual assault, etc.), the visitor will be expelled from the event site immediately and without warning and the matter will be reported to the police.
    8. If there is an aforementioned important reason and the organizer expels the visitor from the venue, the ticket and wristband lose their validity and the admission price will not be refunded. Anyone who culpably violates these GTC shall be liable to compensate the organizer for any resulting damages.
    9. The traffic, escape and rescue/fire protection routes are marked with barrier tape – it is not permitted to park or camp on these routes. Violations will be cleared or towed away for a fee.

Cancellation or interruption of an event; program changes

    1. If the Reload Festival is canceled, the organizer is entitled to a refund of the ticket price. The organizer will not refund any advance booking fees charged by third parties.
    2. The Reload Festival will be held in all weather conditions. However, if the weather conditions give reason to fear danger to life, limb or health for visitors, artists or staff, the Reload Festival will be immediately canceled or temporarily interrupted. In this case, as well as in the event that the Reload Festival is interrupted for other reasons of force majeure, due to an official order or court decision, the visitor shall not be entitled to claim damages, unless the organizer is obliged to assume liability in accordance with Clause 13.
    3. Due to the SarsCov2 virus and the associated Covid19 disease, it is uncertain whether and to what extent events can take place. In the event of cancellation of the event due to an official order due to the SarsCov2 virus, the above Sections 10.1. and 10.2. shall apply accordingly if, after weighing up all the circumstances, the organizer comes to the conclusion that the event must be cancelled due to the SarsCov2 virus, in particular due to a danger to life and limb of the participants in the event or the visitors, due to entry restrictions on the participants in the event or the visitors or due to contract terminations by third parties, such as subcontractors, for whom the organizer cannot procure a replacement.
    4. One ticket entitles the holder to attend a large number of concerts and accompanying events on the event site. In the event of program changes, the cancellation of individual shows or program items, the removal of individual concerts from the program, including so-called headliners, the visitor therefore has no claims against the organizer as long as the overall character of the Reload Festival is preserved. Delays and postponements of individual program items must be accepted by the visitor. The organizer will announce any changes immediately on www.reload-festival.de.

Health impairments, especially due to noise

    1. Visitors are aware that the volume at the event is particularly high, especially in front of the stages, and that there is a risk of possible damage to health, especially hearing damage. Visitors are strongly recommended to use suitable hearing protection, to keep a sufficient distance from the loudspeakers and stages and to choose a position in front of the respective stages that is compatible with individual hearing habits.
    2. The visitor is also aware that pyrotechnics, smoke machines, lasers, strobe lights or other special effects may be used during the event, especially during performances. The visitor undertakes to take suitable and reasonable self-protection measures and to seek a safe place at the first sign of a negative health effect, in particular an epileptic seizure.

Protection of minors

    1. The provisions of the law on the protection of young people in public apply to every event.
    2. Children and young people under the age of 6 are not permitted on the event grounds. Children and young people between the ages of 6 and 16 may only enter the event site if accompanied by a person with parental authority or a person with parental responsibility. A person with parental authority is any person over the age of 18 who, on a permanent or temporary basis, performs educational duties on the basis of an agreement with the person with parental authority or who looks after a child or young person in the context of education or youth welfare (§ 1 Para. 1 No. 4 JuSchG). Admission is free for children up to and including the age of 12.
    3. Children and young people under the age of 18 are only allowed to stay in the camping area after midnight.
    4. Persons with parental authority must carry written proof of their authorization and present a copy of the identity card of the person with parental authority upon request.
    5. The organizer is entitled to refuse children and young people access to the event if there are sufficient indications that the person with parental authority or guardianship is not fulfilling their duty of care to the required extent.

Liability

    1. Visitors enter the event site at their own risk.
    2. The organizer, its legal representatives or its vicarious agents shall only be liable in cases of intent or gross negligence.
    3. The above limitation of liability does not affect the liability of the organizer for the breach of essential contractual obligations, even in the case of simple negligence, but limited to the foreseeable and contract-typical damage. Essential contractual obligations are obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely.
    4. The above limitations of liability do not apply to damages resulting from injury to life, body or health, or insofar as the organizer has fraudulently concealed a defect or assumed a guarantee and for cases of liability under the Product Liability Act.
    5. In accordance with the above limitations of liability, the organizer is not liable for lost or damaged items. Parking in designated parking spaces or the camping area is at your own risk.

Right to one’s own image

    1. The organizer and third parties commissioned by it are entitled to make image, sound and audiovisual recordings of the visitors (“recordings“) during the events without remuneration for the persons depicted and to use them or have them used in any way, without restriction in terms of time, place and content, in all known and future audiovisual media. This includes in particular the use and exploitation of the recordings in digital form and in online media (in particular on the Internet and there on the organizer’s own website, YouTube channels and social media channels of the organizer and its licensees, agents and legal successors), in print media (in particular magazines, brochures, catalogs, presentations, newsletters, printed and/or collective works), in the form of TV commercials and trailers or in editorial contributions, on image and sound carriers of any kind (in particular CD, DVD, BluRay, memory sticks), on other data carriers and in databases, at trade fairs and events and for advertising purposes. This includes in particular the right to use, distribute, exploit, publicly perform, broadcast, reproduce, archive, make available on demand and make publicly accessible the recordings. The recordings may be modified, altered, color edited, cut or used and exploited together with other content such as images, video, audio and text elements as well as graphics as described above. All rights may also be transferred or sublicensed to third parties for the above purposes.
    2. As the recordings also involve personal data, the information on data processing and the rights of the persons depicted in accordance with the GDPR from the privacy policy [Link] applies.

Final provisions

    1. German law shall apply exclusively.
    2. The organizer reserves the right to change these GTC if there is a valid reason for a change. A valid reason exists in particular if the amendment is necessary in order to (a) react to legal requirements that came into force after the conclusion of the contract, (b) to supreme court rulings or (c) to a change in market conditions in the entertainment and festival industry; (d) to eliminate doubts of interpretation that have arisen; or (e) if an expansion of the offer makes the amendment necessary. The changes shall be deemed to have been accepted by the visitor if he/she does not object to the changes by e-mail to [-] within a period of one (1) month from receipt of the announcement of the changes. If the user does not agree to the changes, he/she shall have the right to terminate the contract without notice until the time at which the changes take effect. In the e-mail announcing the changes, the organizer shall inform the user separately of the significance of the four-week period, his right to object to the change and the legal consequences of his silence. The old GTC shall continue to apply to legal acts performed prior to the changes.
    3. Should any provision of these GTC be invalid in whole or in part, this shall not affect the validity of the remaining provisions.
    4. The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of disputes regarding contractual obligations arising from online sales contracts. The organizer is neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
